Analisis Yuridis Normatif Efektivitas Konvensi Kecerdasan Buatan terhadap Perlindungan Hak Asasi Manusia

The rapid advancement of artificial intelligence has significantly transformed various aspects of human life, including the protection of human rights. While this technology offers efficiency and innovation, its deployment also poses serious risks such as privacy violations, algorithmic discrimination, and disinformation. In response to these challenges, the international community has developed the Framework Convention on Artificial Intelligence, Human Rights, Democracy and the Rule of Law as a global legal instrument. This study aims to examine the effectiveness of the Convention in safeguarding human rights through a normative juridical approach. This research employs a normative legal method using statute, conceptual, and comparative approaches. Legal materials are collected through library research, including international legal instruments, indexed academic literature, and policy documents related to artificial intelligence. The analysis is conducted qualitatively by examining the alignment between legal norms and their practical implementation within the global governance of artificial intelligence. The findings indicate that, normatively, the Convention demonstrates strong potential in integrating human rights principles through a risk-based approach and a lifecycle regulatory framework. However, in global practice, its effectiveness remains limited due to weak enforcement mechanisms, its soft law character, regulatory fragmentation, and disparities in state capacity. Therefore, normative reconstruction is required through strengthening legal binding force, enforcement mechanisms, global regulatory harmonization, and the incorporation of human rights by design principles in technological development. This study contributes to the advancement of international legal scholarship by proposing a more adaptive and responsive regulatory framework for artificial intelligence governance, while offering strategic recommendations to enhance a human rights-oriented global governance system.
